inamin na nila 2 dun sa yahoo grps nila...it was inspired by that song...minadali nga lang daw kasi pagkagawa ng kanta...but according to Clem(gtarist), ang plagiarism daw, may 7note rule...hanggang di naabot ang 7notes ng isang kanta, itz not the same song....fan ako pero bothered din kasi ako dun..

o well, pinoy naman kasi talaga pinka walang originality...hehe..

nevertheless nakakaLSS pa rin ung song...

ah talaga, may ganon palang rule, so they can get out of it due to technicalities,

im a big fan of orange and lemons, too bad na may issue rin pala sa kanila na rip off. . .

oh well, matagal na practice yang ganyan sa music industry natin, there was even a time na nauso yung mga "of the phillipine" titles ng mga artist, like elvis of the phillipines. . .  

ayun, and yes, nakaka LSS pa rin nga mga song nila, hehehe  :lol:

though katunog nya ung sa the care, atleast hindi nakakbadtrip ung kanta...maganda pa rin pagkakagawa and therE's this DISTINCT filipino touch sa lyrics and delivery...you can even hear rico blanco's phrasing style on the chorus...hindi tulad ng Cueshe...though the first two notes lang daw ang tulad sa The Greatest View, it STILL SUCKS...halatang pacute...o well, my opinion...:oops:

haha, sounds like he's justifying ripping off songs just as long as you don't reach those seven notes.

tanong lang mga brad.. . kasama ba sa album nila yang theme ng pinoy big brother?. . . ang pag ka alam ko kasi wala sa album nila yan, ginawa lang talaga para sa tv show na iyon. malamang malaki kinalaman ng tv netwok jan, syempre sila mamumuhunan, kailangan sure hit yung theme song, so perfect combination yung pag kuha sa O&L (dahil sa pagsikat nila) at ng kantang ginamit, na hinango sa ibang kanta, iba kasi yung malakas ang recall sa tao eh, mas sure hit nga naman, tingnan nyo mga kanta ng lumang e-heads, diba???

opinion lang po, pwede po kayong sumangayon o hindi sa aking komento  8)

unang-una po sa lahat:

"mahirap pong gumawa ng kanta..."

mahirap ding iwasan na may katunog yung kanta na ginawa mo...

(ex: yung "G-Em-C-D" chord pattern.... siguro mga 10 songs kapareho nun)

let's face it, medyo katunog nga nya yung kanta ng THE CARE pero it doesn't mean na mga CERTIFIED KOPYADOR na sila...

let's give some credit to the bulacan boys (ONL)...

at least yung kanta nila nakaka-inspire ng mga PINOY...

astig pa rin sila. atchaka marami na sila mga malulufet na songs bago pa sila nagka-issue na ganito....


mas magalit kayo sa mga grupo na puro COVER SONGS na lang ang ginagawa para sumikat....

'di ba mas mukha silang SELLOUT?

hmmm, yun ba yung mga "band/artist" na puro remake lang, kadalasan acoustic ang banatan??? hehehe  :lol:  iv got nothing againts acoustic bands, pero na papansin ko nga rin na bakit 95% ata sa mga songs nila e remake lang. . . ang masama eh, nanalo pa ng award for best group.  :twisted:

ako rin, i have nothin' against acoustic bands (do they deserve the term "band"? hehe) pero puro REMAKE na lang kasi sila eh....

in fairness naman sa "iba" jan... lalo na yung nagREMAKE ng KANTA ng mga MASAHISTA ("tell me where it hurts")....

... ASTIG yung mga ORIGINAL songs nila... kalungkot lang isipin na napaka-dependent nila sa mga cover songs para sumikat....

i saw in text tube (GMA7, pag tapos ng news and current affairs program nila ng weekdays) paolo santos has a project band (as in full band, with a drummer, and bass player, and keys), with fellow "acoustic artist" pido (formerly known as pido and take 1). . . and they play electric guitars. . . show band type yung tugtugan nila.

Just to comment...

The difference between what OnL and the PnE case is...

With PnE, they usually make parody versions of songs; and this is
not plagiarism, chiefly because they are not trying to pass the
parodies as their originals. The problem in this only lies whether
they asked a permission or not from the original artists and if they
credited the originators of the parodied songs in the albums where
such these came out.

With OnL, I think, it's graver...because what they did was
plagiarism, 'attempting to pass the song in question as an
original'; in effect making fools out of people who, all along,
thought that they were patronizing something original; and to think
that the message of the song is about Filipino pride and ingenuity.
Very ironic and self-deprecating.

Anyway, inamin na naman ng OnL sa yahoogroups nila na derived nga sa
Care's "Chandeliers" yung "Pinoy Ako." Kala raw kasi nila e di aabot
sa ganito. Iba nga lang s'yempre ang press release nila in public.
Siguro naman, mag-iingat na sila sa susunod na compositions nila. At
least, they learned a lesson from it.

Actually, according to a Manila Bulletin article e biglang lumakas
nga raw ang demand sa albums ng OnL, pati na rin sa 'Diamonds and
Emeralds" ng Care. Hahaha! Utang na loob pa nina Paul Simpson and
Ian Broudie.

Ngayon, nasa public na yan kung ano magiging reaction nila sa mga
bagay na ganyan.

As for me, I wouldn't mind if an artist derived a composition from
another song as long as she does it with integrity and dignity--
meaning, she asked permission at least from the local distributor of
the song and then credit the originators in the album.

Ang nakakaasar lang e yung kung lulusot e lulusot. Tapos buking na e
parang ginagawa pang [chewbacca] yung listeners by insisting that the two
songs were different from each other. Sabagay, technically speaking
nga naman, "Pinoy Ako" and "Chandeliers" are two different songs. Of
course! They're not the same, but they are similar because the
former is the Filipino version of the latter.

PS:
Originality is different from creativity, and the former will always
be more important than the latter.

Music writer blows whistle against Orange and Lemons
The sore truth is that pop band Orange and Lemons ripped-off "Chandeliers" by ‘80s duo The Care and used the melody for "Pinoy Ako" according to music correspondent Giselle Roque who beseeched Manila Bulletin after she read an article this broadsheet published last Oct. 5.

"When I was posting e–mails that certain artists did not ask permission [from The Care] and copied ‘Chandeliers, I did not mention Orange and Lemons. But they were the ones who reacted and posted their own defense in turn so that was the time that established na kinopya nila talaga yung kanta," Roque, who is also the niece of rock icon Sampaguita added.

"‘We did make it Carish’ went Orange and Lemons ‘admission’ and they have the guts to say that these are two different songs?" pointed out Roque, who is a friend of Paul Simpson, who wrote and sang "Chandeliers" for the album "Diamonds and Emeralds."

The other half of The Care duo is Ian Broudie. "Chandeliers" was credited to Broudie/Simpson, like the rest of the songs in the said album, published under Warner Chappell, Ltd. The Care, which was formed in 1983, was most noted for the singles "My Boyish Days," "Flaming Sword," and "Whatever Possessed You."

Roque disclosed to the Bulletin that she could not believe it when Orange and Lemons posted on an e-group mail she received that they were just waiting to be noticed by Simpson and his camp. "They said, ‘At last, this is just what they’ve been waiting for—to get noticed.’ They also said that at least now, people are researching The Care’s music. My point is how could people research it if you don’t acknowledge that you got the song from The Care? Ang isinagot ni Clem (Castro of Orange and Lemons) ‘E bakit kami magpapaalam? Magpasalamat pa nga ang The Care at pinasikat namin ang kanta nila. It was really frustrating. They even wrote, ‘Do we have to find people who are avid fans of The Care and ask permission from them?’ Well, if they’d ask me, they didn’t have to track down Care fans, only the person who wrote the song they ripped–off."

She further revealed that "Orange and Lemons said that they were pressured and did not know what else to do. Since they were listening to The Care, to that effect, they decided na ‘puwede’ ang ‘Chandeliers.’ I have the e–mail from Orange and Lemons to prove this including the time line explaining they had to rush the song because ABS-CBN gave them barely a week to do it and record the video for ‘Pinoy Ako.’"

The said ‘time line,’ Roque gathered, came up when earlier queries were thrown against the band in certain e–groups both Orange and Lemons and Roque belong to.

She continued, "At that time they were commissioned to do the melody of the song, they were listening to The Care and thought that it’s some sort of natural tendency to come out with something that sounds like but I’ve heard of ‘Pinoy Ako’ and that’s not katunog. When I heard on board a bus, I was almost sure that ‘Chandelier’s’ lyrics are next after the intro so you could just imagine the shock when Tagalog lyrics settled in! I was like ‘Oh my God! What is this?’ I didn’t know who ripped the song off that time but same thing, I thought ‘This is very sad. This is very frustrating.’ Then, somebody from the States e–mailed me that they saw it on ABS–CBN’s ‘Big Brother.’"

Meanwhile, ABS–CBN’s official statement on the issue was: "ABS-CBN commissioned Orange and Lemons to compose the music, arrange and perform an original song, ‘Pinoy Ako,’ as the theme of ‘Pinoy Big Brother.’ Any inquiry with regard to this matter should be addressed to the band and Universal Records (Orange and Lemons music label)."

A staunch believer of Indie musicians and OPM, Roque was prompted to come out after she read the band’s denial in the Bulletin, which she described, "Dumbfounding. How could they (Orange and Lemons) deny they copied the song when I have all the e–mails to prove them wrong?" noted Roque who has been a music writer for Pulp music magazine since 2003.

Paul Simpson happened to be in constant correspondence with Roque "and as a friend of Paul, it’s unfair for Orange and Lemons to rip-off his song without asking for Paul’s permission. They know very well that I can relay the message for them; instead they apologized to me saying ‘apologies to ma’am Giselle;’ and that they’re sorry if it caused me sleepless nights, that they are willing to treat me out for coffee—which I felt was very insulting—and the best part is that they said they’re sure that The Care wouldn’t mind. I replied to that e–mail and said ‘why are you apologizing to me?’ They never apologized to Paul or Ian Broudie about the whole event!"

The bottomline was, told Roque sharply is that, "Orange and Lemons are making it sound as if it’s OK to copy melody of a foreign song then use it in their own song that ironically speaks about Filipinos."

Roque said she had a hard time believing that the local act did rip–off "Chandeliers." She stressed, "I’ve long heard [of] rumors long before ‘Pinoy Ako’ became a hit that the song is parehong-pareho ng ‘Chandeliers’ but of course I did not want to believe because the people from Orange and Lemons are my friends. In fact it was me that firstly introduced them through Pulp magazine and before they were featured, my editor then had to ask me if I really know them. It was quite a struggle before I finally came out with the feature that started their rise."

Because she had been in constant connection with Simpson, Simpson’s Brit music label Skyray and the label’s representative Nick Halliwell, Roque notified the concerned individuals. "Right now, they are waiting for a move from Warner Chappell’s because they own the rights of the song," Roque revealed.

Asked why she decided to come out with these allegations, she replied, "Paul is my friend but other than that, I have no stake in this thing. Nothing. I just happen to know the truth and I don’t mind sharing it with people who may have been humming a song they believed [to be] original. You just have to listen to both songs to conclude that it’s a violation of intellectual rights."

O&L should at least had the balls to acknowledge the care as soon as they've released that song.

Bakit nga ba mga naglalabasan na mga bagong banda ngayon... makahawak lang ng gitara, makapalo lang ng drums, may kontng boses lang eh magtatangka ng pumasok sa Mainstream na tipong influence naman nila talaga eh si andrew e lang naman. Pag hinamon mo sa technicalities mga familiar names lang na musikero ang mababanggit. makakaskas lang ng gitara... rockstar na agad pero ingay lang naman ang pinuproduce nya. pag nagdrums naman sabik na sabik sa rolling kahit wala na sa hulog ang pasok ng fill ins nya.... ewan ko ba... mga sample nyan eh ang Orange and Lemons, Cushe, Hale, tsaka ano nga ba yung kumanta ng Hari ng Sablay... ah Sugarfree. Prof nga pala ng Ex ko yung gitarista nyan... nung time na yung sobrang feeling na nun na magaling sila... WALA DIN NAMAN!!!. Mga parekoy ang akin lang... Kasi dito satin sa Pinas... kung ano yung basura yun ang binibili ng masa...Sana sa Music Industry ng Pilipinas eh ayusin na!!! HINDI LANG PUROS PERA PERA... mga producers kasi  basta maibenta lang ayos na sa kanila... Nabenta nga sa masa pero basura naman KAYA TULAD NETONG ONL magkapera lang kahit mangopya ng kanta ayus lang atleast sikat at may pera sila diba? (pero basura parin tingin ko sa kanila!!!!)

Masasabing marami ngang kanta na may G-Em-C-D na chord pattern pero iba ang Melody iba ang Rythm sa kaso ng ONL pareho lahat tapos sasabihin pa nila na ORIGINAL nila yun???? Bulsyet!!! Nung nilabas yung issue tungkol sa pangongopya hindi naman sila binanggit kasi nga BLIND ITEM pero bakit sila nagreact kaagad? Guilty kasi and ang kapal pa ng mukha nilang sabihin na influence nila ang The Care at sabihin na kung hindi dahil sa kanila hindi makikilala ang The Care? Kung ganitong klase ng musikero at ganitong klase ng musika ang mauuso di bale na lang.Sana mangyari ulit yung nangyari nung early and mid 90's yung lahat ng banda na naririnig mo puro orig ang kanta at masasabing walang kahawig.

Kanina habang binabasa ko mga posts eh medyo napaisip lang.... Di kaya pakulo iyon ng ABS-CBN? Maaaring sinadya un ng ABS-CBN na magrip-off ng music ang Orange and Lemons para magkaroon ng issue at lalong sumikat ang kanta pati na din ang show nila na Pinoy Big Brother.....
Tignan nyo naman ang ginawa nila kay Willie ng Wowowits, Binigyan din nila ng issue at sikat na sikat ngaun di ba?? Sumunod yata si Julius Babao, nagpyansa daw s terorista???!!!! Ang labo!!!!..hahahaha Palagay ko gimmick lang yan ng ABS-CBN... Di lang siguro makaimik ang Orange and Lemons dahil masisira sila sa ABS-CBN at Star Records.... La lang, Pag-isipan nyo din... Wawa naman masyado Orange and Lemons... Napakinggan ko ibang kanta nila, talagang astig ang pagkakagawa at tipong hindi makapagcompose lang sabak na kaagad! Talagang obre maestra... unang una, hindi kasama sa strike while the iron is hot yung theme song ng PBB. . .

meaning ginawa lang talaga yung song para sa show na iyon, and marahil pera pera na ang puinag uusapan. . . sabi nga bad publicity is still a good publicity. habang mainit at pinag uusapan, mas sumisikat yung kanat, at ganun na rin yung banda, which will lead to more money for them. . . or the company. . .

Palagi ko na lang naririnig yang kantang iyan kahit saan ako magpunta, kagabi nga lang yan ang pinapatugtog ng mga tambay sa tapat namin habang nag-iinuman tapos paulit-ulit at nagsising-along pa ang mga kumag. Nakakalungkot isipin na ang paborito nilang kanta ay ginaya lang pala.

yeah, i also think about that whenever i hear people singing along to that song. it's also embarrassing how it's sort of like an anthem to filipinos these days... i mean, it's a song about pinoy pride but it's a rip-off of some western band's song. the ironyyy. :?

March 1998 noong na-released yung "Alay Sa Kabataan - Dodong Cruz With Friends"..........It's a compilation album recorded by Paragon Records and distributed by Ivory Records.............."Before Sunday" is the name of my band before...

I remembered going to NU 107, noong nasa Strata building pa sila..........Para lang mag-promote ng album individually and show some new materials...........Honestly I didn't want any compensation at all, kung meron ok kung wala ok na rin.............But the thing is I really really like what I am doing.............

No regrets at all kahit na alam naming nag-me-mellow down na ang rock & roll music at that time, kinagat pa rin namin ang offer.............It's all in the memories............. :)  :)  :)  :)  :)  8)  8)

Most of my bandmates before were now living abroad............Isa na lang ang natira, nahihilig pa sa pitbull keysa sa music.............Kung tungkol naman sa mga kilala sa music industry marami kung marami.............Kaso sino ba naman ang makaka-alala sa isang hamak na "emil murillo"................Sino ba siya at kailangang kilalanin..........

Ano ba naman yung may naka banggaan kang mga kilalang pangalan noon...................And take note, they treated you like they were your long time friend................Artista, Rock Artist, Producers, DJ's, Band Managers, Writers, Sound Directors, pati Accountant ng Ivory Records..................Eh sino ba naman ako para pagkaabalahan at alalahanin..................

My point is, I am glad I have the memories................And I am glad I still have the Passion and the Talent..................That's why I am still up for an experience.............

yung friend ko kapatid ni clem from ONL.... yup, original song po nila yun... kasabay kasi yun ng ABOT KAMAY na kanta nila (para sa kalaban na shampoo brand) kaya iba (yata) yung kumanta sa unang version... pero sila talaga nagsulat nun... kaya kung mapapansin nyo, biglang naging si clem na yung kumanta dun sa updated version.... hehe.. kasama po yun dun sa bagong album ng ONL.  :-D
