sampling and dj mixing: any rights violated here?
« on: August 07, 2007, 03:11:55 PM »
im into sampling lately, im just wondering if im breaking any rules when i sample some artists' voice or whatever, and i trigger them live. i put effects ofcourse. but im not sure if im crossing any lines here since dj's mixes so many songs without artist' consent.

thanks for any input.

The basic rule of thumb is that if you earn money out of someone else's work, you WILL get sued unless you have that person's permission to use his work. Sampling laws aren't strictly implemented here but it can change if Filscap and Pari have something to say about it.

basically, you will have to deal with the owner of the copyright for the recording and for the song from which you took the sample.

Look for royalty free loops and samples to be on the safe side.

then you are all good. but as soon as oyu start making mix tapes, remixes and start doing releases, you had better have the samples cleared first with the publishing company. in the US, intellectual rights is a huge platform for suing and it can ruin you legally if you aren't careful.
