questions about covering/recording a dead band's song..
« on: April 12, 2005, 06:04:41 PM »
guys, is it legal if you are going to record an album and one song there is an original song of a band that was already disbanded a long time ago, maybe 1-2 years ago. i mean, for example i am the one that will record the album - am i still going to faces criminal charges eventhough the band was already dead?

try consulting a lawyer who knows about copyright and intellectual property rights here, just to be sure.

personally, if you're just going to cover them, then you have to expressly and clearly state that your song is a cover, and give credit to whom credit is due.

if you're going to pass off the work as your own, though, the real question would be: patutulugin ka ba ng kunsensiya mo, knowing that you're a fake? think about it
